इलाहाबाद हाईकोर्ट ने एक महत्वपूर्ण फैसले में पति को आत्महत्या के लिए उकसाने की आरोपी साधना देवी को सशर्त जमानत दे दी है।
कोर्ट ने अपने आदेश में कहा कि किसी को “परेशान करना” आत्महत्या के लिए उकसाना नहीं माना जा सकता। साधना देवी मिर्जापुर के विंध्याचल की रहने वाली हैं और 18 मई 2025 से जेल में बंद थीं।

यह आदेश न्यायमूर्ति आशुतोष श्रीवास्तव ने आरोपी की अधिवक्ता दिव्यांशु तिवारी और शैलेश कुमार उपाध्याय के तर्कों को सुनने के बाद दिया।
बचाव पक्ष ने कोर्ट में दलील दी कि मृतक द्वारा लिखे गए सुसाइड नोट में पत्नी पर कोई आरोप नहीं लगाया गया है, बल्कि उसने यह लिखा है कि
“मेरी पत्नी को कोई आरोप न लगाएं।”
अधिवक्ता ने तर्क दिया कि आत्महत्या के लिए उकसाने का कोई ठोस सबूत नहीं है।
उन्होंने यह भी कहा कि साधना देवी को झूठा फंसाया गया है और एफआईआर घटना के 10 दिन बाद दर्ज कराई गई। सुसाइड नोट मृतक की पैंट की जेब से मिला था। इसके अलावा, साधना देवी के खिलाफ कोई अन्य आपराधिक मामला दर्ज नहीं है।

कोर्ट का फैसला:
कोर्ट ने बचाव पक्ष के तर्कों से संतुष्ट होकर साधना देवी की जमानत मंजूर कर ली। कोर्ट ने उन्हें व्यक्तिगत मुचलके और दो प्रतिभूति (श्योरिटी) जमा करने का निर्देश दिया, जिसके बाद उन्हें जेल से रिहा कर दिया जाएगा।
यह फैसला इस बात पर जोर देता है कि किसी व्यक्ति को परेशान करना और उसे आत्महत्या के लिए उकसाना, दोनों अलग-अलग कानूनी अवधारणाएं हैं, और सिर्फ परेशानी के आरोप पर आत्महत्या के लिए उकसाने का अपराध सिद्ध नहीं हो सकता।
